Terms of service

These terms govern the use of flouster, an online ticketing and project management platform for teams. By contracting the service or using an account, you accept what is described here.

1. Who can subscribe

To use flouster you must be of legal age and have the capacity to enter into binding agreements.

If you subscribe on behalf of a company, firm, agency, or any other organization, you represent that you have sufficient authority to bind it. In that case “you” refers to both you and that organization.

2. What the service is

flouster is an online platform that brings together, for an organization’s team, tickets, projects, goals, meetings, questionnaires, reports, CRM, chat, and a wiki with documents. It includes ticket capture over WhatsApp with AI-assisted triage, an API with keys, and an MCP server to connect AI assistants. It is provided as software as a service: no copy of the program is delivered and access happens over the internet.

The organization may enable a client portal so its own clients can see their project progress, deliverables and tickets, and raise requests. The organization decides who gets access and is responsible for how those people use the portal.

We may improve, modify, or retire features. If we retire a core feature of what you contracted, we will give you reasonable advance notice.

3. Access to the service

flouster has no open sign-up. Access starts with a demo booked with our sales team at ventas@flouster.com. After it, you can try the service with your team free of charge for 15 calendar days. When the trial ends, if you decide to subscribe, the commercial terms are agreed; if not, we deactivate the trial workspace and notify you before deleting its content.

The organization’s accounts are created by flouster or by the organization’s administrator, once the service has been contracted.

4. Accounts, roles, and responsibilities

The platform distinguishes these profiles, each with different permissions:

  • Organization owner: contracts the service, is responsible for payment, and may transfer ownership or close the account.
  • Administrator: manages members, permissions, brands, and settings; acts on behalf of the organization.
  • Team member: collaborates on projects, tasks, and tickets according to assigned permissions.

You are responsible for keeping your credentials and any API keys you generate confidential, and for activity under your account. Tell us immediately at hola@flouster.com if you detect unauthorized use.

The organization is responsible for who it gives access to, the permissions it grants, and the content its team uploads.

5. Pricing and billing

Prices are not published: they are quoted according to the size of your team. The proposal or contract you accept sets the amount, the currency, the billing period, and the payment method.

Unless the proposal states otherwise, amounts exclude VAT and other applicable taxes, which are added when invoicing.

We issue digital tax receipts with the details you register. Keeping those details correct and current is your responsibility.

6. Term, cancellation, and refunds

The service is contracted for the period stated in your proposal or contract, and renews as agreed there. You may cancel by writing to hola@flouster.com before the renewal date; cancellation takes effect at the end of the period already paid, and you keep access until then.

As a general rule we do not refund periods already started. If there was a duplicate charge, an error on our side, or a serious service failure that prevented you from using it, write to hola@flouster.com and we will resolve it case by case.

None of the above limits the non-waivable rights granted to you by Mexican law.

7. Price changes

We may adjust prices. Any change will be communicated by email at least 30 calendar days in advance and will apply from your next renewal, unless your contract provides otherwise. If you do not agree, you may cancel before that date.

8. Acceptable use

When using flouster you agree not to:

  • Use the platform for unlawful or deceptive activities, or ones that infringe third-party rights.
  • Upload content that infringes intellectual property, or personal data you have no right to process.
  • Send spam or malware, attempt to breach security, access other organizations’ data, or interfere with the service.
  • Resell, sublicense, or grant access to the platform to third parties outside your organization.
  • Automate usage, including through the API and the MCP server, in ways that degrade the service, or circumvent the agreed limits.
  • Reverse engineer the software or copy its look and behavior to build a competing product.

9. Your content

Everything you upload — projects, tickets, documents, files, messages — remains yours or your clients’, as applicable. flouster claims no ownership over it.

You grant us a limited, non-exclusive, revocable license to host, process, transmit, and display that content for the sole purpose of operating the service and supporting you. That license ends when you delete the content or close your account, except for backup copies that expire under our retention periods.

You can obtain your information while your account is active, through the API or by requesting it at hola@flouster.com.

10. Our intellectual property

The platform, its code, design, brand, name, and documentation belong to flouster and are protected by applicable law. We grant you a limited, non-exclusive, non-transferable right of use while your contract is in force.

We welcome improvement suggestions; if you send them, we may use them freely with no obligation to compensate you.

11. AI features and the WhatsApp channel

flouster AI classifies reports, proposes a category and a priority, asks for missing details and splits several requests into separate tickets. Its output is a suggestion: it remains subject to your team’s review and does not replace anyone’s professional judgment.

Enabling the WhatsApp channel is optional and your organization decides whether to do it. If you do, you agree to comply with the WhatsApp platform policies and to inform the people whose phones you register that their messages are used to file and handle tickets. The availability of that channel depends on third parties and may change for reasons outside flouster’s control.

AI features may be subject to reasonable usage limits. We will let you know if a limit affects the way you use the service today.

12. Data protection

The processing of personal data is governed by our privacy notice, which forms part of these terms.

When you upload personal data about your clients or third parties, you are responsible for having a legal basis to do so and for informing those people. flouster acts as processor and handles that data only on your instructions.

13. Service availability

We work to keep the platform continuously available, but interruptions may occur due to maintenance, updates, or causes beyond our control. Scheduled maintenance will be announced with reasonable notice.

Service level commitments (SLA) apply only if your contract expressly includes them.

14. Suspension and termination

We may suspend or terminate your access if you breach these terms, if payment fails after we notify you, or if your usage endangers the security or operation of the platform for others.

Except in serious or urgent cases, we will notify you first and give you the chance to fix the situation. On termination, you may request an export of your information during the period stated in the privacy notice and in your contract.

15. Warranties and limitation of liability

The service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted or error-free, or that its output — including flouster AI’s classifications and suggestions — will be accurate or fit for a particular purpose. Decisions you make based on platform information are your responsibility.

To the extent permitted by law, flouster’s total liability to you, for any cause, will not exceed the amount you paid for the service in the 12 months preceding the event giving rise to the claim.

We are not liable for indirect or incidental damages, lost profits, lost goodwill, or data loss where you failed to keep backups of information you consider critical.

16. Indemnity

You agree to hold us harmless against third-party claims arising from your content, your use of the service in breach of these terms, or the lack of a legal basis to process the personal data you upload.

17. Changes to these terms

We may modify these terms. The current version will be published on this page with its update date and, if the change is significant, we will notify you by email or inside the platform at least 30 calendar days in advance.

If you keep using the service after the change takes effect, you are deemed to accept it. If you do not agree, you may cancel.

18. Force majeure

Neither party will be liable for failures caused by events beyond its reasonable control, such as widespread internet or infrastructure provider outages, natural disasters, or acts of authority.

19. Governing law and disputes

These terms are governed by the laws of the United Mexican States.

Before turning to formal channels, please write to hola@flouster.com: most matters are resolved that way.

If you are a consumer, you may turn to the Mexican consumer protection authority. For any other dispute, the parties submit to the competent courts of the United Mexican States, waiving any other jurisdiction that might apply.

If you use flouster from another country, this does not deprive you of the non-waivable rights granted by the law of your place of residence.

20. Final provisions

If any clause is found invalid, the rest remains in force. Our failure to exercise a right immediately does not mean we waive it. These terms, together with the privacy notice and the proposal or contract you accepted, constitute the entire agreement between the parties. If the signed contract contradicts these terms, the contract prevails.
